Terms and Conditions

AmazonQuest is an online marketplace and discovery platform that connects travelers ("Travelers") with independent lodges, eco-lodges, tour operators, and hosts ("Hosts") offering travel experiences in the Amazon rainforest region across Peru, Brazil, Ecuador, Colombia, and Bolivia.

AmazonQuest is a connector only. We provide a platform where Travelers can discover experiences and communicate with Hosts. We do not own, operate, manage, or control any of the experiences, lodges, tours, or accommodations listed on the Platform. We are not a travel agency, tour operator, or party to any agreement made between a Traveler and a Host.

AmazonQuest is currently operating in a beta phase. During this phase:

• The Platform facilitates discovery and communication between Travelers and Hosts.
• AmazonQuest does not process payments. Any payment for an experience is arranged and made directly between the Traveler and the Host, outside of the Platform.
• AmazonQuest does not collect or hold passport details, payment card information, or banking information. Travelers should never share such information through the Platform's chat. Any sensitive information required to finalize a booking must be exchanged directly between Traveler and Host through their own private channels.
• AmazonQuest does not guarantee the quality, safety, legality, or accuracy of any experience, and provides no booking guarantee, refund guarantee, or traveler protection at this stage.

We may introduce integrated payments and additional traveler protections in the future. These Terms will be updated accordingly before any such feature becomes active.

You must be at least 18 years old to create an account or use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information;
• Keep your login credentials confidential;
• Be responsible for all activity that occurs under your account;
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be involved in fraudulent, harmful, or unlawful activity.

As a Traveler, you understand and agree that:

• Any booking request you send is a request only and does not constitute a confirmed booking until the Host accepts it and you and the Host agree on the final details directly.
• Once a Host accepts your request, you will coordinate payment, exact dates, transport, and all final arrangements directly with the Host, outside of the Platform.
• You are solely responsible for evaluating the suitability, safety, and legality of any experience before committing to it.
• You are responsible for ensuring you have appropriate travel insurance, vaccinations, visas, and any other documents or precautions required for travel to the Amazon region.

As a Host, you understand and agree that:

• You are solely responsible for the accuracy of the information you publish about your experiences, including descriptions, photos, prices, availability, and capacity.
• You are solely responsible for delivering the experiences you offer in a safe, lawful, and professional manner, and for complying with all applicable local laws, licenses, permits, taxes, and regulations in your country of operation.
• You are an independent operator. You are not an employee, agent, partner, or representative of AmazonQuest.
• You are responsible for handling payment, contracts, liability, and any disputes directly with the Traveler.

The Platform allows users to post content, including messages, reviews, photos, and experience listings ("User Content").

• You retain ownership of the User Content you submit, but you grant AmazonQuest a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content for the purpose of operating and promoting the Platform.
• You are solely responsible for your User Content and represent that you have all necessary rights to post it.
• You must not post content that is unlawful, false, misleading, defamatory, obscene, infringing, harassing, or that violates the rights of others.

We reserve the right, but not the obligation, to review, moderate, edit, or remove any User Content at our discretion, without notice.

You agree not to:

• Use the Platform for any unlawful or fraudulent purpose;
• Impersonate any person or entity, or misrepresent your affiliation;
• Attempt to circumvent, disable, or interfere with the security or functioning of the Platform;
• Use automated systems (bots, scrapers) to access the Platform without our permission;
• Collect or harvest personal data of other users;
• Post or transmit malware or harmful code;
• Use the Platform to harass, threaten, or harm others.

The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, AmazonQuest does not warrant that:

• The Platform will be uninterrupted, secure, or error-free;
• The information provided by Hosts is accurate, complete, or reliable;
• Any experience listed will meet your expectations or be safe, lawful, or as described.

Any agreement, transaction, or interaction between a Traveler and a Host is solely between those parties. AmazonQuest is not responsible for the conduct, performance, acts, or omissions of any Traveler or Host, whether online or offline.

To the fullest extent permitted by applicable law, AmazonQuest, its operator, and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Platform or your interactions with any Host or Traveler.

In particular, and without limitation, AmazonQuest shall not be liable for:

• Any injury, harm, loss, or damage suffered during or in connection with any experience;
• Any failure of a Host to deliver an experience, or any cancellation, change, or dispute;
• Any payment made directly between a Traveler and a Host, including fraud, non-delivery, or non-refund;
• Any loss arising from sharing sensitive personal or financial information outside our recommendations.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Italian or European Union law.

You agree to indemnify and hold harmless AmazonQuest and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your User Content, your interactions with other users, or your violation of these Terms.

The Platform relies on third-party service providers (such as hosting and database infrastructure) to operate. We are not responsible for the practices of those third parties. Their handling of data is described in our Privacy Policy.

The Platform, including its design, text, graphics, logos, and software (excluding User Content), is owned by AmazonQuest and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.

We may suspend or terminate your access to the Platform at any time, with or without notice, if you violate these Terms or engage in conduct we reasonably consider harmful to the Platform, other users, or third parties. You may stop using the Platform and delete your account at any time.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Significant changes will be communicated where reasonably possible. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Italy. Any dispute arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Trento, Italy, subject to any mandatory consumer protection rights you may have under the law of your country of residence.
